1.1 "Company" refers to Infinity Mobile NV, the legal entity that invented, developed and created Ask Emma. Ask Emma is part of Sayl Cloud, an omnichannel commerce platform. Infinity Mobile registered address is Hoogstraat 29, 9850 Deinze, registered in Belgium, VAT No. BE0640.980.849
1.2 "Partner Merchant" refers to any person, firm, company or unincorporated association which subscribes to the Service by executing the relevant Application Form.
2.2 By visiting and/or ordering services on this Application, you agree and where required you consent to the collection, use and transfer of your information as set out in this policy.
3. INFORMATION THAT WE COLLECT FROM YOU
3.1 When visiting or making an order through our Application or other, you may be asked to provide information about yourself including details such as your name and contact details. We do not ask or store your payment information, this is done on the platform of the payment providers that are linked to Ask Emma. We may also collect information about your usage of our Application and information about you from the messages you post to our Application and the emails or letters you send to us.
4. USE OF YOUR INFORMATION
4.2 Your information may be used to contact you for your opinions on our services and to inform you about significant changes or developments to our Application or our services.
4.3 Where you have specified as a result, you agree that we may use your information to let you know about our other products and services that may be of importance to you including services that may be the subject of direct marketing and we may contact you to do so by post, telephone, mobile messaging (e.g. SMS, MMS etc.) as well as by email.
4.4 Where you have indicated accordingly, you agree that we may also share your information with third parties (including those in the food, drink, leisure, marketing and advertising industries) to use your information in order to let you know about goods and services which may be of importance to you (by post, telephone, mobile messaging (e.g. SMS, MMS etc.) and/or e-mail) and to help us analyse the information we collect so that we can control, support, develop and grow our business and services to you.
4.5 If you do not wish for us to use your data in this way or if you change your mind about being contacted in the future, please tell us by using the contact details set out in section 8 below and/or amending your profile accordingly.
4.6 Please note that by submitting comments and feedback concerning our Application and services, you consent for us to use such comments and feedback on our Website and in any marketing or advertising materials. We will only identify you for this purpose by your first name and the city in which you reside.
5. DISCLOSURE OF YOUR INFORMATION
5.1 The information you provide to us will be transferred to and stored on servers in Belgium or at a destination outside the European Economic Area, and may be retrieved by or given to our staff working outside Belgium and third parties together with companies within the Ask Emma group of companies (which means our subsidiaries, our ultimate holding company and its subsidiaries) who act for us for the purposes set out in this policy or for other purposes notified to you from time to time in this policy. Countries outside the European Economic Area do not always have strong data protection laws but we will always take steps to ensure that your information is treated in agreement with this policy.
5.3 If you have consented we may allow carefully selected third parties, including marketing and advertising companies, our affiliates and associates, to contact you occasionally about services that may be of interest to you. They may contact you by telephone, SMS as well as by e-mail. 6. SECURITY AND DATA RETENTION
6.1 We take steps to guard your information from unauthorised access and against unlawful processing, accidental loss, destruction and damage. We will keep your information for a reasonable period or as long as the law requires.
6.2 Where you have chosen a password which allows you to access certain parts of our Application, you are responsible for keeping this password confidential. We strongly suggest you do not share your password with anyone.
6.3 Unfortunately, the transmitting of information via the internet is not fully secure. Although we will take steps to protect your information, we cannot promise the security of your data transmitted to our Application; any transmitting is at your own risk. Once we have received your information, we will use strict measures and security structures to try to prevent unauthorized access.
